PLEASE READ CAREFULLY
I authorize all previous employers to furnish MSP Resources, Inc.,
to the extent permitted by Federal or State law, my record, reason
for leaving, and all information they may have concerning me,
and I release them to MSP Resources, Inc., from all claims, demands, or liability for any damage arising from such investigation. By signing this
application, I authorize MSP Resources, Inc., to make investigations of my work, education, and other matters related to my suitability for employment,
and I indicate my awareness that false statements or failures
to disclose certain information may be sufficient to disqualify
me for employment, or, if employed, may result in my dismissal.
If employed, I agree to conform to the rules and regulations of
the employer. I further agree that in absence of written employment
contract of definite duration, any employment resulting from this
application may be terminated, with or without cause, at any time
at the option of the employer or myself. I understand that no
representative of MSP Resources, Inc., other than the president
of the company, shall have any authority to enter into any agreement
for any specified period of time, or to make any agreement contrary
to the foregoing.
This

PRE-DISPUTE RESOLUTION
AGREEMENT
It is MSP
Resources, Inc.'s (the 'Company') desire, whenever possible, to
resolve disputes in a fair and expeditious manner, reflecting
the interests of the concerned parties. Although there is no outstanding
dispute now between parties, it is recognized that, as with any
relationship, differences may arise which may not be resolved,
and regarding which the parties may seek relief before a court
or arbitrator.
In consideration of the Company employing you, you and the Company
each agrees that, in the evvent either party (or its representatives,
successors or assigns) brings an action in a court of competent
jurisdiction relating to your recruitment, employment with, or
termination of employment from the Company, the plaintiff in such
action agrees to waive his, her or its right to try by jury, and
further agrees that no demand, request or motion will be made
for trial by jury.
In consideration of
the Company employing you, you further agree that, in the event
that you seek relief in a court of competent jurisdiction for
a dispute covered by this Agreement, the Company may, at any time
within 60 days of the service of your complaint upon the Company,
at its option, require all or part of the dispute to be arbitrated
by one arbitrator in accordance with the rules of the American
Arbitration Association. You agree that the option to arbitrate
any dispute is governed by the Federal Arbitration Act, and fully
enforceable. You under- stand and agree that, if the Company exercises
its option, any dispute arbitrated will be heard solely by the
arbitrator, and not by a court. The fees and expenses of the arbitrator
will be paid by the Company.
This pre-dispute resolution
agreement will cover all matters directly or indirectly related
to your recruitment, employment or termination of employment by
the Company; including, but not limited to, claims involving laws
against discrimination whether brought under federal and/or state
law, and/or claims involving co-employees but excluding Workers'
Compensation Claims and the National Labor Relations Act.
The right to a trial, and to a trial by jury,
is of value.
YOU MAY WISH TO CONSULT AN ATTORNEY PRIOR TO SIGNING THIS AGREEMENT.
IF SO, TAKE A COPY OF THIS FORM WITH YOU. HOWEVER, YOU WILL NOT
BE OFFERED EMPLOYMENT UNTIL THIS FORM IS SIGNED AND RETURNED BY
YOU.
This

ACUERDO de DESISTIMIENTO de la DEMANDA

El deseo, cuando sea posible, de MSP Resources, Inc. (la Empresa) es dirimir controversias de una manera justa y con prontitud, tomando en cuenta los intereses de las partes concernientes. Aunque al momento, no existe ninguna controversia entre las partes, es justo decir, como en lo de cualquier relación, pueden surgir diferencias que no se pueden solucionar, y las partes tal vez busquen compensación ante un juez o un árbitro.
A cambio de que se le emplee por la Empresa, ambos, usted tanto como la Empresa concuerdan que si en el evento que cualquiera de las partes (o sus representantes, sucesores o asignados) entabla una acción ante un juez con jurisdicción en conexión con su reclutamiento, empleo, o eliminación de empleo con la Empresa, el querellante en dicho proceso concuerda renunciar el derecho a un juicio con jurado y además concuerda que ninguna solicitud, pedimento o moción será tomada ante un juicio con jurado.
A cambio que se le emplee por la Empresa, usted además acuerda que en caso de que recurra ante un tribunal con jurisdicción, buscando compensación por una instancia incluido en este Acuerdo, la Empresa podrá, en cualquier momento dentro de 60 días a partir de haber recibido notificación de su demanda contra la Empresa, como opción, requerir que toda o parte de la demanda sea arbitrada por un árbitro, de acuerdo con las reglas de la American Arbitrator Association (Asociación Americana de Árbitros). Usted concuerda que la opción de arbitrar cualquier litigio será gobernada por la Federal Arbitration Act (Ley Federal de Arbitración), y que cabalmente se puede hacer valer. Usted entiende y concuerda que, si la Empresa ejerciese esta opción, cualquier disputa arbitrada será escuchada solo por el árbitro y no por un juez. Los honorarios y costas del árbitro estarán al cargo de la Empresa.
Este acuerdo de desistimiento de una demanda tomará en cuenta todas las cuestiones, directas o indirectamente relacionadas con su reclutamiento, empleo o extinción de relación de trabajo con la Empresa; incluyendo, pero no limitadas a, demandas involucrando leyes contra la discriminación, sean estas presentadas bajo leyes federales o estatales y, o demandas involucrando colaboradores, pero excluyendo demandas de Compensación de Trabajadores, y la Ley del Trabajador.
Es de valorar, el derecho a un juicio y a un juicio con jurado.
USTED TAL VEZ QUERRÁ CONSULTAR CON UN ABOGADO, ANTES DE FIRMAR ESTE ACUERDO, SI ASÍ ES, TOME CON USTED UNA COPIA DE ESTE DOCUMENTO, SIN EMBARGO, NO SE LE OFRECERÁ EMPLEO HASTA QUE ESTE DOCUMENTO FIRMADO POR USTED SEA ENTREGADO.
